Official Rules

 

The Sponsor of this Competition is TOKYOPOP Inc.

 

1.     NO PURCHASE NECESSARY TO ENTER OR WIN. The Competition is open only to legal residents of the 50 states of the United States and the District of Columbia who are at least 13 years of age as of the date of entry. Void where prohibited or restricted by law. Employees, contractors and their families of the following are ineligible to enter or win: TOKYOPOP Inc. (“TOKYOPOP”), and its parent, subsidiary, and affiliated companies. Employees and their families of TOKYOPOP’s advertising and promotional agencies are also ineligible to enter or win.

 

2.     The Competition begins at 12:01 a.m. PST on March 21, 2008, and ends at 11:59 p.m. PST April 8, 2008.  Entries submitted after 11:59 p.m. on April 8, 2008, are ineligible to win. You can only enter this Competition by: (1) creating a profile on TOKYOPOP.com, (2) joining the Fever clan at www.tokyopop.com/Fever/clans/Fever (this requires you to be or to become a member of the Fever clan, which is free), (3) reading volume 1 of Fever manga (“Manga”), (4) writing, by yourself, an original review of the Manga (“Review”), (5) uploading and posting your Review to the Fever clan.  Only one entry per email address or person will be eligible. All entries must be completed and submitted online. No other methods of entry will be accepted.

 

3.     You acknowledge and agree to abide by the Terms of Service located at  http://www.tokyopop.com/legal/terms_of_service.html and to the Fan Art Policy located at http://www.tokyopop.com/legal/fan_art_policy.html.

 

4.     You acknowledge and agree the Manga is owned by TOKYOPOP and Hee Jung Park.  You shall acquire no copyright or other ownership of the Manga as the result of its incorporation into your Review.  You are not granted any rights in the Manga, Review or any TOKYOPOP intellectual property.  Your violation of any of these provisions or your unauthorized or improper use of the Manga shall entitle TOKYOPOP to pursue all legal and equitable rights and remedies, including, without limitation, its right to injunctive relief.

 

5.     You hereby grant TOKYOPOP, and its respective successors and affiliates a perpetual and irrevocable, exclusive, royalty free, worldwide license in all rights, titles and interests of every kind and nature now or hereafter known in your, including but not limited to (1) all copyrights and trademarks therein, (2) the right of reproduction of the Review in any and all media whether now known and/or hereafter devised, in whole or in part, (3) the moral rights of artists in the Review in whole or in part, and (4) all rights of manufacture, merchandising, recordation, reproduction, translation, adaptation, display, and exhibition of the Review in whole or in part and the right to make modifications thereto and derivatives thereof, in any and all media whether now known and/or hereafter devised and by any and all means or methods.  Pursuant to this license, TOKYOPOP, its licensees, and their respective successors and assigns shall be entitled to and shall solely and exclusively have the right to exploit throughout the world all rights in the materials you prepare with respect to the Review together with the rights generally known as the "moral rights of authors" in and/or to any proceeds of your services with respect to the Review, including but not limited to the right to add to, subtract from, arrange, revise, adapt, rearrange, and make variations of the Review, and to use all or any part of the Review in new versions, adaptations, derivative works, prequels, and sequels in any and all languages, and to obtain copyright therein in the name of TOKYOPOP.  Without in any way limiting the foregoing, you acknowledge and agree that TOKYOPOP, its licensees, and their respective successors and assigns shall have the right to freely sell, license, assign, and otherwise transfer any and all of the rights granted by you to TOKYOPOP hereunder, and to exercise all such rights in connection with any advertising, publicity, promotional materials, and distribution rights in connection with your submitted Review.

 

6.     TOKYOPOP is not responsible for human error, computer hardware or software malfunction, Internet connection or transmission problems or failures, or Internet traffic congestion, which may affect an entry or attempted entry.  TOKYOPOP reserve the right, at its sole discretion, to cancel, modify or terminate the Competition.  Furthermore, TOKYOPOP reserves the right, at its sole discretion, to disqualify any entrant deemed to have (a) tampered or attempted to tamper with the entry process or the operation of the Competition or TOKYOPOP’s website; (b) violated these Official Rules; (c) violated the Terms of Service, conditions of use and/or general rules, or (d) cheated, destroyed, obstructed, or otherwise acted illegally or in bad faith in relation to this Competition.

If the Competition is terminated prior to 11:59 p.m. (PST), April 8, 2008, eligible online entries received prior to termination will remain qualified for the grand prize.  All entries must be completed and submitted personally by the entrant. Collection of personally identifiable information will be made pursuant to TOKYOPOP Inc.’s Online Privacy Policies posted at http://www.tokyopop.com/policy/privacy.php

 

7.     The First Place Prize is prize pack comprised of:  the posting of your Review on www.tokyopop.com, The Complete Guide to Manga, Hotel Africa manga, and one TOKYOPOP t-shirt, with a total retail value of approximately $50. One (1) winner will be chosen after 11:59 p.m. on April 8, 2008, from eligible submissions by a panel compromised of TOKYOPOP employees

 

The Prize is non-transferable and has no cash equivalent, except as indicated above.  The Prize cannot be exchanged or returned for cash. Taxes on the Prize are the sole responsibility of the winner. TOKYOPOP reserves the right in its sole discretion to substitute a prize of comparable value or cash in the amount of $50, but substitution of the Prize by the winner is prohibited. If the winner cannot be notified by email or does not accept the Prize within three (3) days after the Prize is awarded, the Prize will be forfeited and the runner up will become the winner.

 

8.     By entering this Competition, you consent to TOKYOPOP’s use of your name for promotional purposes, including online announcements, without additional compensation, except where prohibited by law.  If you are the winner, TOKYOPOP may require you to furnish proof of identity, address, and birth date as a condition to awarding the Prize to you. TOKYOPOP may also require you to sign (i) an agreement releasing TOKYOPOP from all liability in connection with personal injury or death, damage, theft, or loss in connection with the Competition and the acceptance, receipt, possession, or use of the Prize, and (ii) a publicity release, unless prohibited by law, permitting TOKYOPOP to advertise your name and state of residence.  If you are the winner and you’re under the age of 18, your parent or guardian must also sign such agreements and releases. Failure to present such proof or sign such additional releases within three (3) days after notification by email will result in disqualification and forfeiture of the prize, which may be awarded to the runner up.

 

9.     TOKYOPOP will announce the winner at http://www.tokyopop.com by April 11, 2008, and will ship the Prize on or before May 31, 2008, to the winner’s mailing address in the United States.

 

10.    By participating in the Competition, entrants and their parents or legal guardians agree to be bound by these rules and the decisions of TOKYOPOP, which are final in all matters relating to this Competition.
