TOKYOPOP® RISING STARS OF PROSE: The Dreaming

 

OFFICIAL RULES

 

No purchase or entry fee required.

No entries accepted before February 1, 2008, or after April 15, 2008.

 

The sponsor of this competition is TOKYOPOP Inc., 5900 Wilshire Blvd.,

Suite 2000, Los Angeles, CA 90036.

 

All entries must be sent to the sponsor by mail.

 

1    Eligibility

 

·       The Rising Stars of Prose: The Dreaming competition (the “Competition”) is open to all legal residents of the 50 United States, Washington D.C., or Puerto Rico, but not to anyone ineligible under reasons listed in 3 below.

 

1.1       You must be at least 13 years old to enter the Competition.If you are at least 13 but under 18, your parent or legal guardian must also complete and sign the official Competition Entry Form.

 

1.2       We will accept only one (1) entry per person; therefore, all multiple entries from the same person will be ineligible (so only send us your story in its final state, no revised entries). You must enter using your true name (so no pen names). Each entrant must complete and sign the official Competition Entry Form available at http://assets.tokyopop.com/contestrules/RSOP/RSOPEntry.htm.

 

2    How to enter

 

2.1    Write a short story that:

 

·       is your original work, but is based on the characters, concept, and the world of Queenie Chan’s The Dreaming manga

·       has never been published or exploited anywhere

·       is a self-contained English-language story running at least 20 pages but no more than 40 pages in length, typed in a 12-point font in black ink, double-spaced, on 8 ½” x 11” white paper.

·       begins with a separate title page that includes only the printed title of your story, your name, and total number of pages of the story

·       does not include any artwork

·       meets all requirements in TOKYOPOP’s entry specifications, which you may read and download at http://assets.tokyopop.com/contestrules/RSOP/SubGuidelines.htm

 

2.2    Print your name, your telephone number, title of your story, and the page number in the header or footer of each page of your story.

 

2.3    Complete the official Competition Entry Form (which you may download from TOKYOPOP’s web site at http://assets.tokyopop.com/contestrules/RSOP/RSOPEntry.htm). Mail the completed and signed Entry Form in the same envelope with a high-quality 8-1/2" by 11" photocopy of your story to:

Mail us only the photocopy. TOKYOPOP is not responsible for returning any original manuscripts so be sure to keep your original.

 

2.4     Your entry must be postmarked no earlier than February 1, 2008, and no later than April15, 2008. You are responsible for all postage costs. Submissions received by TOKYOPOP with a postmark later than April 15, 2008 will not be considered. TOKYOPOP is not responsible for misdirected, lost, delayed, late, partial, incomplete, or damaged entries. Proof of mailing does not constitute proof of delivery.

 

3    Ineligibility

 

3.1    Your entry will be ineligible for consideration if:

 

·       your Entry Form is incomplete, illegible, unsigned, the terms have been modified in any way, or you have not confirmed that you have agreed to and abided by these Official Rules

·       your entry is incomplete or does not meet the entry specifications at http://assets.tokyopop.com/contestrules/RSOP/SubGuidelines.htm

·       your entry is made electronically (for example, by email or on a computer disk or CD)

·       your entry is not original (e.g., it is plagiarized) or contains any reference to or depiction of any real person who is now living or to any real product, company, or organization

·       your entry contains excessive violence or sex, or other shockingly repellent behavior or scenes as determined by the judges

·       you do not comply fully with all of these Official Rules or you fraudulently enter the Competition

 

3.2    Employees, volunteers, interns, and agents of TOKYOPOP Inc., its advertising, public relations, and promotion agencies, and its distributors, and their immediate families (spouse, parents, children, and siblings and their respective spouses) and individuals living in the same households of such persons are ineligible to enter or win.

 

4    How entries are judged

 

4.1     Eligible entries will be judged and winners selected by TOKYOPOP’s panel of judges, composed of TOKYOPOP editors, development executives, and other employees. The judging criteria includes:

 

·      story telling (completeness and consistency)

·      originality

·      grammar, syntax, and style

·      content and whether it follows the canon as set out  in Queenie Chan’s The Dreaming manga.  ‘Canon’ is all the information that can be gleaned from the original three volumes of The Dreaming manga; in other words, anything Queenie Chan has established about her characters and world in print.

·      characterizations and their likeness to Queenie Chan’s original manga

·      reader enjoyment

 

4.2    The decisions of TOKYOPOP’s panel of judges will be final.

 

5    Prizes

 

5.1    Available prizes in the Competition are:

 

·      First Place: one (1) prize of $500 in cash

·      Second Place: one (1) prize of $100 in cash

·      Third Place: one (1) prize of $100 in cash

 

5.2     Not all prizes may be awarded, depending on the number and quality of entries.

 

5.3     A single prize is awarded for each winning entry. In the event of a tie, the entries of the finalists will be re-judged by an additional judge who will serve as a tie-breaker.

 

5.4     Prizes are non-transferable and must be accepted as awarded. No substitutions may be made.  

 

5.5     Taxes on prizes are the sole responsibility of the winners.

 

5.6     Each Competition winner is eligible to become a potential writer for a full-length prose novel adaptation of Queenie Chan’s The Dreaming manga.

 

5.7     If you are a Competition winner, TOKYOPOP may require you to furnish proof of identity, address, and age as a condition to awarding the prize to you. TOKYOPOP may also require you to agree to and sign additional release(s) to use and publish your winning entry and, unless prohibited by law, a publicity release. Failure to present such proof or sign such additional releases will result in disqualification and forfeiture of the prize, which may be awarded to an alternate winner.

 

5.8     Winners will be officially announced at BookExpo America 2008 (May 29 through June 1, 2008) in Los Angeles, CA. If you are a Competition winner, TOKYOPOP will send you a notification by certified mail. Notification will be mailed to your address listed in the Competition Entry Form you submit.  Prizes must be claimed as directed in the notification within ten (10) days after the notification is mailed or will be forfeited and may be awarded to an alternate winner. TOKYOPOP is not responsible for undeliverable, misdirected, or lost notifications.

 

5.9     A list of winners will be available during the period May 30, 2008, through July 30,  2008, by mailing a self-addressed, stamped #10 business envelope to:

Winners will also be listed on our website at http://www.tokyopop.com/ starting June 1, 2008.

 

6        Use of entries and advertising, publicity, and promotion

 

6.1       By entering the Competition, you are agree :

 

·         You have read and accept all the terms and conditions under the Official Rules,

·         To grant to TOKYOPOP

1)unlimited but non-exclusive right to publish, use, adapt, edit, and/or modify your entry in any way, including in commerce, and in any and all media worldwide including without limitation the Internet and in TOKYOPOP’s business activities including, but not limited to, TOKYOPOP’s Pop Fiction Sampler book(s), marketing and publishing, without limitation and without compensation;

2)unlimited usage of your entry and your name and city and state of residence for any promotional purposes related to the Competition, including the 2008 Pop Fiction Sampler book(s) and all other TOKYOPOP’s business activities; and,

3)the right to display and critique your entry (or excerpts) on the Internet and to use your name and city and state of residence in connection with such display and critique.

4)a perpetual and irrevocable, exclusive, royalty free, worldwide license in all rights, titles and interests of every kind and nature now or hereafter known in the your entry (“Entry”), including but not limited to (1) all copyrights and trademarks therein, (2) the right of reproduction of the Entry in any and all media whether now known and/or hereafter devised, in whole or in part, (3) the moral rights of authors or artists in the Entry in whole or in part and (4) all rights of manufacture, merchandising, recordation, reproduction, translation, adaptation, display and exhibition of the Entry in whole or in part and the right to make modifications thereto and derivatives thereof, in any and all media whether now known and/or hereafter devised and by any and all means or methods.

 

Pursuant to the grant of rights set forth in this paragraph 6.1, TOKYOPOP and its licensees, successors, and assigns shall be entitled to and shall solely and exclusively have the right to exploit throughout the world all rights in the materials prepared by you with respect to the Entry together with the rights generally known as the "moral rights of authors" in and/or to any results and proceeds of your services with respect to the Entry, including but not limited to the right to add to, subtract from, arrange, revise, adapt, rearrange, and make variations of the Entry, and to use all or any part of the Entry in new versions, adaptations, derivative works, prequels, and sequels, each in any and all languages, and to obtain copyright therein in the name of TOKYOPOP.  Without in any way limiting the foregoing, you acknowledge and agree that TOKYOPOP and its licensees, successors, and assigns shall have the right to freely sell, license, assign, and otherwise transfer any and all of the rights granted by you to TOKYOPOP hereunder, and to display any advertising, publicity, promotional materials and distribution rights in connection with your submitted Entry.

 

 

6.2       If you are a Competition winner, you grant TOKYOPOP:

 

·         the exclusive right to publish, use, adapt, edit, and/or modify your entry in any way, including in commerce, and in any and all media worldwide including without limitation the Internet and in TOKYOPOP’s business activities including, but not limited to, TOKYOPOP’s Pop Fiction Sampler book(s), marketing and publishing, without limitation and without compensation; and,

·         the right to use your name, likeness, and excerpts from your entry in connection with the advertising, publicity, and promotion of your winning entry.

 

6.3    By entering the Competition, you represent that your entry and our use of your entry will not infringe upon the rights of any third parties.

 

7        Other terms

 

7.1    The Competition is not a sweepstakes, lottery, or game of chance. It is a judged competition. No purchase is required or entry fee charged.

 

7.2     Your entry becomes TOKYOPOP’s property and will not be returned, and TOKYOPOP assumes no responsibility for its loss or destruction; therefore, submit only an 8-1/2" by 11" high quality photocopy of your story, not the original copy.

 

7.3     By entering the Competition, you agree to waive any right to claim ambiguity or error in these Official Rules or in the conduct or outcome of the Competition itself.

 

7.4     You acknowledge and agree that the copyright and all other intellectual property rights in The Dreaming manga books (“Books”) are owned by TOKYOPOP and Queenie Chan. You shall acquire no copyright or other ownership of any intellectual property rights in the Books as the result of incorporation of any characters, settings, or other elements thereof into your Entry. You are not granted any rights in the Books, Entry, or any other TOKYOPOP intellectual property. Your violation of any of these provisions or your unauthorized or improper use of the Books shall entitle TOKYOPOP to pursue all legal and equitable rights and remedies, including, without limitation, injunctive relief.

 

7.5  TOKYOPOP reserves the right to modify these Official Rules in any way and at any time without prior notice.

 

7.6     Applicable federal, state, and local laws apply. Void where prohibited or restricted by law.
