Your submission must:

 

q       Include a completed and signed entry form

 

q       Be not less than 20 or more than 40 letter-sized (8-1/2" x 11") pages of typed, double spaced text using a 12 point type font such as Arial, Times, or Times New Roman – do not use A4 or legal sized paper

 

q       Be an 8½″ x 11″ photocopy – do not send the original

q       Have your name, phone number, title, and page number printed in the header or footer of every page

 

q       Have a title page (in addition to the 20 to 40 pages of text) that meets all requirements as specified in submission details

 

q       Have all pages affixed together by one paper clip – no staples

 

q       Be postmarked on or before April 15, 2008

The person signing below certifies that he or she is submitting this Entry Form to TOKYOPOP Inc., 5900 Wilshire Blvd., Suite 2000, Los Angeles, CA 90036 (“TOKYOPOP”), with the understanding and agreement that the information is true and complete and that TOKYOPOP may rely upon this Entry Form without necessity of further inquiry.

 

The person signing below certifies, affirms, warrants and represents that he or she has read all of the Official Rules (the “Official Rules”) for the TOKYOPOP Rising Stars of Prose: The Dreaming Competition (the “Competition”), that he or she has fully and unconditionally complied with and will fully and unconditionally comply with all of the Official Rules, and that he or she has committed no fraud, misrepresentation, or deception in entering the Competition. The person signing below further certifies, affirms, warrants and represents that neither he or she, nor members of his or her immediate family or household, are employees of TOKYOPOP or any of its affiliates, subsidiaries, or other parties prohibited by the Official Rules from entering the Competition.

 

The person signing below acknowledges and irrevocably agrees that:

 

·         he or she grants TOKYOPOP the right to use, without further consent or payment, his or her name and/or likeness, voice, photographs, and biographical information and/or any statement made by him or her concerning the Rising Stars of Prose competition and/or any prize and that any or all such elements may be used by TOKYOPOP in any and all media in perpetuity throughout the world as TOKYOPOP in its sole discretion sees fit.

 

·         if his or her entry is chosen as a winner in the competition, he or she grants TOKYOPOP (and its parent, affiliates and representatives) a worldwide, royalty-free, exclusive right and license, but not an obligation, to use, reproduce, publish, distribute, and display the winning submission and his or her name, address, and other personal information (in whole or in part) in any media now or hereafter known and in perpetuity, and he or she agrees to execute a specific consent for such uses if asked to do so and agrees to the announcement of his or her name, city, and state on TOKYOPOP’s web site and other online information services and in printed advertising, publicity, and promotional materials issued by or under authority of TOKYOPOP.

 

 

·         TOKYOPOP bears no liability whatsoever for any personal injury, loss, or damage of whatever kind (including loss of data) caused directly or indirectly, in whole or in part, from downloading any material from TOKYOPOP’s web site, regardless of whether the material was prepared by TOKYOPOP or a third party, and regardless of whether the material is connected to TOKYOPOP’s web site by a hypertext link. TOKYOPOP takes no responsibility for the content of third party web sites that may be linked to TOKYOPOP’s web site by a hypertext link. TOKYOPOP reserves the right to cancel or modify the Competition if fraud, technical failures, or any other factor beyond TOKYOPOP’s reasonable control impairs the integrity of the Competition as determined by TOKYOPOP in its sole discretion. In the event of such impairment, TOKYOPOP may choose potential winners from all eligible entries received as of the time of impairment.

 

·         if he or she is a winner of the Competition, by acceptance of any prize, he or she agrees to release, indemnify and hold harmless TOKYOPOP and its affiliates, directors, officers, employees, and agents from any liability for damage, injury, death, loss, cancellation, or other liability arising from acceptance or use of any prize or substitute prize or his or her participation in the Competition, including without limitation personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy or from any misuse or malfunction of such prize or substitute prize. Nothing in these Official Rules shall be taken to exclude any liability for death or personal injury caused by the negligence of TOKYOPOP. TOKYOPOP and its affiliates, directors, officers, employees, and agents assume no liability whatsoever for losses incurred as a result of cancellation of the Competition or for any reason whatsoever or through the acts or defaults of any company or person providing any prize or for events occurring after the award of such prize. All such losses or expenses shall be borne entirely by the individual winner.
